Zofran is a powerful anti-nausea drug which uses the active ingredient ondansetron to block serotonin receptors, suppressing stomach discomfort. The medication is typically used to combat nausea and vomiting in cancer patients after they undergo radiation or chemotherapy treatments, or go through surgery or take other drugs that may induce nausea. Zofran has no impact whatsoever on motion sickness, but aside from postoperative and post-cancer therapy applications Zofran is also used as a last-resort to suppress morning sickness experienced by pregnant women when other drugs have failed. Many possible side effects of taking Zofran are stated on its label, but Zofran prescribed to pregnant women to treat their morning sickness is an off-label application of the drug’s abilities. While off-label use of many drugs is commonplace, it comes with many risks and a major set of legal liabilities. Zofran use during pregnancy is not approved by the Food and Drug Administration (FDA) and has been linked to a number of serious birth defects. GlaxoSmithKline, the corporation that sells Zofran, promoted off-label use of Zofran as a nausea suppressant for pregnant women through both advertisements and bonuses to doctors, and failed to warn these doctors or the pregnant women they serve about the possibility of birth defects. Heart defects (including heart murmur, atrial septal defect, ventricular septal defect, and hole in the heart), cleft lip, cleft palate, restricted growth and musculoskeletal failures, kidney defects (including hydronephrosis, or water on the kidneys), and hypospadia (a developmental failure of the urethra) are among the most common birth defects manifested in the children of women who took Zofran for morning sickness while pregnant. If you or a woman in your life took Zofran for morning sickness while pregnant and the child was born with any of these extremely life-altering defects, you may have a claim to benefits that can cover the cost of medical expenses or other costs associated with the ailments.

Corporations and their attorneys seek only to protect their financial interests; they will not voluntarily offer you a package that covers all of the costs – financial, physical, or emotional – you faced after taking Zofran during pregnancy and giving birth to a child with major birth defects. If you try to handle your case without representation a number of possible pitfalls stand before you, from filing at the wrong time to undervaluing the benefits package that addresses all of your Zofran-related needs. If you and your child were the victims of unstated birth defect risks presented by the anti-nausea drug Zofran prescribed to you off-label during pregnancy, do not handle your claim alone. A Grimes Teich Anderson personal injury attorney should be representing you to ensure your case is fought at its best. Grimes Teich Anderson LLP only represents innocent victims.
