Despite recent efforts to make scooter laws more stringent, if your scooter has an engine smaller than 50cc and cannot exceed a speed of 30 miles per hour when driven on a flat surface, these rules apply:
  • You must be at least 16 to drive on public roads in North Carolina In South Carolina you must be at least 14 years of age.
  • You must wear a helmet in North Carolina; helmets are not required in South Carolina;
  • You do not need a driver’s license in North Carolina In South Carolina you must have a valid driver’s license, permit or moped operator’s license.
  • You do not need liability insurance;
  • You do not have to register your vehicle;
  • You do not need to get your vehicle inspected;
  • If your vehicle exceeds the engine size/speed requirements, it must be registered as a motorcycle, and motorcycle laws apply.

This simplicity of regulation sounds ideal, but it also means that some motorists are not ready for the proliferation of scooters on the road and do not take sufficient care to avoid collisions. Scooters must obey the rules of the road, but they also have equal right to use the public roads (excluding interstates). The fact that scooters are not required to have liability insurance does not affect the scooter operator's right to make a claim against another driver who caused injury.
